How to Deduct TDS on Rent Under Section 194-IB: New Rates and Filing Form 26QC

1. I pay ₹55,000 rent per month. Do I need to deduct TDS?
Yes. If you are an individual or HUF and your monthly rent exceeds ₹50,000, you are legally required to deduct TDS under Section 194-IB.
2. What is the current TDS rate?
As of October 1, 2024, the rate is 2%. For the period before this date in the same financial year, the rate was 5%. If your landlord fails to provide their PAN, you must deduct 20%.
3. Do I need to deduct TDS every month?
It is a one-time annual requirement. You deduct the total TDS for the entire financial year from the rent payment of the last month (March) or the last month of your stay if you move out earlier.
4. Do I need a TAN to pay this tax?
No. Unlike business owners, regular individual tenants do not need a TAN. You can perform the entire process using your PAN.
5. How do I deposit the tax and what forms are involved?
Form 26QC: This is the “Challan-cum-statement” used to pay the tax online via the TIN-NSDL or Income Tax portal. It must be filed within 30 days from the end of the month in which the deduction was made. Form 16C: This is the TDS certificate you must download from the TRACES website and give to your landlord within 15 days of filing Form 26QC.
6. What happens if I miss the March 31 deadline?
You may be labeled an “assessee in default.” This attracts: Interest: 1% per month for late deduction and 1.5% per month for late payment. Late Fee: ₹200 per day for late filing of Form 26QC. Penalty: Potential penalty of up to ₹1 lakh under Section 271H.
7. I claim HRA; am I exempt from deducting TDS?
No. Claiming House Rent Allowance (HRA) for your own tax savings is separate from your responsibility to deduct TDS on the rent you pay to your landlord. If the rent is >₹50,000, you must do both.
